Terms of Service

These Terms of Service (the "Terms") govern your access to and use of The Mambo Guild (the "Service"), an online dance education platform operated by Pavle Popovic, with registered office at Via Pasquale Revoltella 92, 00152 Roma (RM), Italy, VAT IT18528951009 (the "Provider", "we", "us"). By creating an account or paying for a subscription you accept these Terms.

1. Account

To access most features you need an account. You must be at least 16 years old (or the age of digital consent in your country, if higher) and provide accurate information. You are responsible for keeping your password confidential and for all activity under your account. Notify us at support@themamboguild.com promptly of any unauthorised use.

2. Subscription, pricing and renewal

The Service is offered on a subscription basis. Available plans, prices and billing periods are shown on the pricing page before purchase. All prices are in the currency shown at checkout and include applicable VAT for consumers resident in the EU.

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing portal linked in your account settings; cancellation takes effect at the end of the current paid period. Cancellation, trial cancellation and refunds are described in detail in our Refund Policy.

3. Free trial

New subscribers may activate a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, the first paid period begins automatically. The free trial is available once per payment method. If you pay with a card that has already been used for a trial on any account, including one held by you or another person, your subscription begins immediately and the first month is billed today.

4. Right of withdrawal (digital content)

Consumers resident in the EU have a 14-day right of withdrawal under art. 52 of the Italian Codice del Consumo. Because the Service consists of digital content delivered on demand, by ticking the consent box at checkout you ask us to begin performance during the withdrawal period and acknowledge that you lose the right of withdrawal as soon as a lesson video begins playing (art. 59, paragraph 1, letter o of the Codice del Consumo). 5. Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • copy, redistribute or republish the lessons, videos, or curriculum content;
  • circumvent technical measures that limit access or downloads;
  • share account credentials, including with people in the same household, except as expressly allowed by your plan;
  • scrape, mass-download or feed Service content into a model training pipeline;
  • post, in any community area, content that is unlawful, infringing, harassing, discriminatory, or that you do not have the right to share.

We may suspend or terminate accounts that breach these rules. Community posting is gated on an active paid plan (see Privacy Policy), so account suspension also removes posting access.

6. User content

Any content you post in community spaces (videos, photos, written posts) remains yours. By posting it, you grant The Mambo Guild a worldwide, non-exclusive, royalty-free licence to host, store and display it within the Service for the duration of your account, solely to operate the community feature. You can delete your posts at any time, which terminates this licence for the deleted content.

7. Intellectual property

All lesson videos, written curriculum, branding and visuals on the Service are owned by the Provider or licensed to it. Your subscription grants you a personal, limited, non-transferable right to access the content for your own learning. No other right or licence is granted.

8. Service availability

We aim to keep the Service available continuously but do not guarantee uninterrupted access. Planned maintenance and unplanned downtime can occur. For sustained outages caused by us, see the "Defective service" section of the Refund Policy.

9. Disclaimers and liability

The Service is provided on an "as is" basis. To the maximum extent permitted by law, the Provider disclaims all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be limited under applicable mandatory law.

Where liability can be limited, the Provider's aggregate liability for claims arising out of or relating to the Service is limited to the amounts you paid for the Service in the twelve months preceding the event giving rise to the claim.

10. Termination

You may stop using the Service at any time and request account deletion by emailing support@themamboguild.com. We may suspend or terminate an account for a serious or repeated breach of these Terms, for fraud, or for a legal obligation, with notice when reasonably possible.

11. Changes to the Terms

We may update these Terms over time, for example to reflect changes in the Service or in the law. Material changes will be announced at least 14 days in advance by email to your account address. Continuing to use the Service after the change takes effect means you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by Italian law. For consumers resident in the EU, mandatory consumer protection rules of the country of habitual residence continue to apply. The court of the consumer's place of residence has jurisdiction over disputes arising from these Terms, subject to applicable mandatory rules. For non-consumers, the courts of Rome, Italy have exclusive jurisdiction.
